I read that it’s largely due to established precedent that in cases where a police officer shoots a driver, (happens enough for there to be precedent) the burden of proof is to show beyond a reasonable doubt that the killer did not have cause to fear for their life. Proving something to not be the case is very difficult.
Lucky for us we have the whole thing from multiple angles, including the murderers POV because he whipped out his phone because he wanted a video of the murder that he premeditated.
It’s a high bar, but this is one of the most documented murders in history.
I’ve seen all the videos and unfortunately there is JUST enough to cast reasonable doubt. I know it’s bullshit, you know it’s bullshit, everyone involved knows it’s bullshit, but they can absolutely argue that he “feared for his life”. Her wheels were 100% turned away from him, but was he in a position to examine the angle of her wheels when the car started moving? Or did he just react when the car started moving after he put himself less than a foot from the front corner?
Again, it’s obviously bullshit. He murdered a woman. He willfully put himself in that situation and ended her fucking life because he’s a fucking coward. For drawing his gun alone, he should be prosecuted, let alone firing point blank at an unarmed person posing no threat. But with the amount of leeway the justice system gives law enforcement, he will absolutely be able to argue that he had “reasonable fear” in the moment.
The legal standard isn’t if he was afraid it’s if a reasonable person should have been afraid. That’s a big fucking difference.

He literally had gotten video of her license plate prior to shooting her. He had no need to put himself in front of her car while other officers were screaming at her to drive away. They could have gone after her later, as is typically done with anyone not considered seriously dangerous that is operating a vehicle, but he chose to get in front of her and start shooting when she complied with the order to drive away
Maybe the first shot. The two through the driver’s window make it murder.

Criminal charges is the compromise we’re offering. If they won’t agree to that, if those are the rules they wanna play by, there’s no reason not to shoot ICE agents on sight.
